Terms of Service
Last updated: [publication date]
Version: [terms version]
These Terms explain what you can expect from Brisk Site and what we need from you when you use the service.
1. Who we are
Brisk Site is operated by Miles Wheeler-Smith, trading as Brisk Site.
Email: hello@brisksite.co.uk
Business address: [confirmed business address]
In these Terms, “we”, “us” and “our” mean Brisk Site. “You” means the individual or business entering into the agreement.
2. Who the service is for
Brisk Site is available to UK-based businesses for business use.
By subscribing, you confirm that you are acting for business purposes and have authority to enter into this agreement on behalf of the business concerned.
You must provide accurate account and billing information, keep your contact email up to date and protect access to your account. Contact us promptly if you suspect someone has accessed it without permission.
You will be asked to accept these Terms before checkout. You can review and correct your details before completing payment.
Your paid subscription agreement starts when your first payment succeeds and Brisk confirms your subscription. Failed or abandoned checkout does not start a paid subscription.
We record the Terms version you accept, the timestamp and the account concerned, and provide a subscription confirmation linking to that version.
Our Privacy Notice explains how we handle personal information. The data-processing schedule below forms part of these Terms where we handle personal information on your behalf.
3. What your subscription includes
Brisk provides a template-based business website, hosting, content-editing tools and a Brisk website address.
Available features and content limits are shown in the service. Your subscription does not include bespoke design, bespoke copywriting, a separately registered domain name or ownership of Brisk’s templates and software.
Custom-domain support is not included at launch. Any future paid options will be described separately before you choose them.
You can prepare and privately preview your website before subscribing. This is not a free trial of a paid subscription.
4. Publishing and updating your website
You are responsible for reviewing your website before publishing it, including its contact details, photographs, testimonials and business claims.
Payment does not automatically publish your website. You must complete the publication step, and your website address must be ready before it can be used.
Billing starts when your first payment succeeds, even if you have not yet published.
Edits remain private until you publish an updated version. You are responsible for checking that the public version contains the information you intend to share.
Website addresses are subject to availability and service rules. A Brisk address is provided as part of the service and is not a domain name you own.
5. Price and payment
The launch subscription costs £19 per month, payable in advance. There is no setup fee or paid-subscription trial period.
We are not VAT registered. No VAT is added to the stated price.
Your subscription renews automatically each month unless cancelled. You authorise our payment provider to collect recurring subscription payments using your chosen payment method.
You must keep your payment details up to date. If a payment fails, collection may be retried and your website may become unavailable.
An existing published website normally has a seven-day renewal-payment window after its paid period ends. This does not extend a subscription you have cancelled. Once website access has ended, restoring payment may also require you to publish again.
6. Price changes
We may change subscription prices.
For existing subscribers, we will give at least 30 days’ notice by email before an increase. The new price will apply at the first renewal after that notice period.
You can cancel before the new price takes effect. The launch price is not a lifetime price guarantee.
7. Cancellation, unpublishing and account deletion
These actions have different effects.
Cancelling your subscription
You can cancel through the billing controls available from your dashboard.
Cancellation stops future renewals. Your website remains available until the end of the period you have already paid for, unless you unpublish it, delete your account or it is suspended under these Terms.
After paid access ends, your website becomes unavailable publicly. Your saved content remains available for the retention period described below.
Unpublishing your website
Unpublishing removes your website from public access through Brisk.
It does not cancel your subscription or stop billing. To stop future renewals, cancel the subscription separately.
Deleting your account
You can request account deletion through your dashboard.
Once the request is accepted, your website becomes unavailable and account cleanup begins. We also begin cancelling any remaining subscription.
Deletion of files and provider-held information continues in the background. Some financial, security and deletion records are retained as explained in our Privacy Notice.
Deleting your account ends access before the end of any remaining paid period. We do not ordinarily refund that unused time.
8. Refunds and billing problems
We do not normally provide discretionary refunds for cancellation, unused subscription time or account deletion.
This does not affect remedies required by law or the following exceptions:
- We refund duplicate payments and incorrectly charged amounts.
- If a Brisk fault prevents initial publication and we cannot resolve it, we refund the affected subscription payment.
- If we permanently close the service or end your service for reasons unrelated to your misconduct, we refund the unused prepaid period.
- We correct eligible renewal charges collected after an accepted account-deletion request.
Contact hello@brisksite.co.uk if you believe a charge is wrong. Include enough information to identify the payment, but do not email full payment-card details.
Other service problems will be investigated individually. Nothing in these Terms makes the listed refund cases your only remedy where the law provides otherwise.
9. Saved content and deletion deadlines
Keep your own copies of important text and original photographs.
Our retention rules are:
- Anonymous drafts: scheduled for deletion 30 days after creation unless claimed by an account.
- Accounts that have never subscribed: draft content and uploads are scheduled for deletion after 90 days without a meaningful saved content change. A saved content change restarts that period; signing in, previewing and unchanged saves do not. Subscribing removes the content from this unpaid-draft cleanup rule.
- Former subscribers: website content and uploads are retained for 12 months after the end of your last paid billing period. The seven-day unpaid-renewal access window does not extend that period. An active resubscription stops that scheduled cleanup. Ordinary edits and logins do not restart it.
We show the relevant expiry date in your account and send a reminder 30 days before scheduled deletion of an account’s unpaid draft or retained website content. We submit reminders to your verified account contact. We do not delete that content until at least 30 days after successful submission for delivery. If submission is delayed, the effective deletion date moves later and is shown in your account. Provider acceptance does not guarantee inbox receipt. File removal may continue after the scheduled date, including during provider interruptions.
Email delivery cannot be guaranteed, so keep your contact details current and check the date shown in your account.
Active subscriptions are not subject to these inactivity-deletion rules. Simply unpublishing a paid website does not start a deletion countdown.
Content cleanup does not automatically delete your login account. For MVP, we do not automatically delete login accounts because of inactivity. You can request account deletion through your dashboard.
While content remains available, you can access and manually copy your text. Brisk does not currently provide a downloadable website, bulk content export or original-photo recovery feature. This does not limit applicable personal-data rights or our obligations under the processing schedule.
10. Your content and our platform
You retain ownership of content you own. Other rights holders retain ownership of their material.
You give us permission to store, copy, process, resize, format and publish your content as necessary to provide the service and carry out your instructions. This includes using service providers to perform those tasks.
That permission continues only as needed to provide the service, complete the agreed retention and deletion process, or meet legal obligations.
You must have the rights and permissions needed to upload and publish your content. This includes photographs, logos, testimonials and information about other people.
We retain ownership of Brisk’s templates, design system, software and other platform materials. Your subscription allows you to use them through the service; it does not transfer ownership of them to you.
We will ask for separate permission before featuring your website in our marketing. You can decline without affecting your subscription. You can withdraw permission by emailing us. We will stop future use and remove material we control where reasonably possible, although copies shared by others may remain.
11. Acceptable use
You must not use Brisk to publish or distribute:
- Unlawful, fraudulent, threatening or abusive material.
- Material that infringes someone else’s intellectual property, privacy or other rights.
- Malware, phishing pages or content designed to compromise other systems.
- Impersonation or misleading claims about your identity, business or services.
You must not attempt to bypass access controls, interfere with the service or access another customer’s information.
You are responsible for the accuracy and legality of your business claims, offers and published contact details. Brisk does not verify your qualifications, insurance, work or testimonials.
12. Visitor enquiries and privacy
Where enabled, your website’s enquiry form collects visitor details and delivers them to your verified destination email.
You are responsible for keeping that destination current, monitoring the inbox and using enquiry information lawfully.
If you change your destination email, enquiries continue to use the previously verified address until the replacement is verified. Where no verified destination exists, the enquiry form is unavailable.
An enquiry form is not guaranteed email delivery. Spam filters, mailbox problems and service interruptions may delay or prevent receipt.
We store application copies of enquiries for 90 days, or until your account-deletion request is accepted, whichever comes first. You are responsible for copies received in your own inbox.
You must ensure the Privacy Notice on your website accurately reflects your business’s use of personal information. Brisk’s standard wording describes the platform’s processing; it does not cover every use you may make of an enquiry after receiving it.
The processing schedule below applies to information we handle on your behalf.
13. Support and availability
Support is available by email at hello@brisksite.co.uk.
We will provide the service with reasonable care and skill. We aim to keep websites available, but maintenance, faults and events outside our reasonable control may cause interruptions.
We do not promise uninterrupted availability, a particular uptime percentage, 24-hour support or a fixed support-response time.
Brisk provides website and search-engine foundations, but does not guarantee indexing, search rankings, enquiries, sales or any particular business result.
14. Suspension and termination
We may remove content or suspend access where reasonably necessary to address unlawful activity, serious misuse, security risks or a legal requirement.
For ordinary breaches that can be corrected, we will normally explain the issue and give you a reasonable opportunity to fix it.
Temporary suspension
During a temporary suspension caused by your breach of these Terms, billing continues while you have a reasonable opportunity to correct the issue. We will explain this in the suspension notice.
Suspension does not prevent you from cancelling your subscription or contacting support. If you cannot access the normal cancellation controls, contact hello@brisksite.co.uk.
Where suspension results from a Brisk fault or an allegation that proves unfounded, we will review the affected period and provide a refund where appropriate.
Termination for misconduct
Serious or repeated breaches may result in permanent termination.
If we permanently terminate your service for misconduct, we will stop your subscription and future billing. There is no automatic refund of unused prepaid time, subject to remedies required by law.
We will explain our action where lawful and appropriate. You can contact us to question a decision or provide further information.
Closure or discontinuation
If we voluntarily close Brisk or discontinue your service for reasons unrelated to misconduct, we will give at least 30 days’ notice by email, allowing time to copy your content.
We will stop future billing and refund unused prepaid time.
Urgent legal or security circumstances may require shorter notice.
15. Our responsibility
We will provide the service with reasonable care and skill.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
16. Changes to these Terms
We may update these Terms as the service develops or our obligations change.
For material changes affecting your rights or obligations, we will give at least 30 days’ notice by email, explaining what is changing and when. You can cancel before the changes take effect.
Minor clarifications that do not materially affect your rights or obligations may be made without advance notice. We will update the version and date when we change the Terms.
Legal requirements or urgent security circumstances may require shorter notice. Where possible, we will explain the reason and give advance notice.
We retain previous versions and records of acceptance. Where a change requires fresh agreement, we will ask for it explicitly rather than treating continued use alone as acceptance.
Price increases remain subject to the separate notice and renewal rules in section 6.
17. Contact and disputes
Please contact hello@brisksite.co.uk about service problems, billing questions, complaints or concerns about a website hosted by Brisk.
For a content report, include the website address and an explanation of the concern.
We will try to resolve disputes through direct discussion.
These Terms are governed by the law of England and Wales. The courts of England and Wales will handle disputes relating to these Terms, subject to any mandatory legal protections that apply.
This does not prevent eligible businesses in Scotland or Northern Ireland from subscribing.
Data-processing schedule
This schedule applies where Brisk processes personal information on your behalf. It does not apply to processing for which Brisk independently acts as controller, such as its own billing, account administration and security activities.
A. Roles and processing details
You are the controller of personal information you instruct us to process for your business. Brisk acts as your processor for that information.
Scroll the table to read both columns.
| Item | Scope |
|---|---|
| Subject matter | Hosting and managing your website content and delivering visitor enquiries |
| Purpose | Providing the website service and acting on your documented instructions |
| Activities | Receiving, storing, organising, formatting, displaying, transmitting and deleting information |
| People concerned | Your business contacts, staff, customers, testimonial authors, people appearing in uploaded content and website visitors |
| Information concerned | Names, contact details, business details, photographs, testimonials and enquiry details, including postcode, work type, timing and message |
| Duration | While providing the relevant service and during agreed retention and deletion periods |
The service is not intended for collecting sensitive personal information or criminal-offence information. Do not deliberately use it for those purposes without a separate written arrangement.
You are responsible for the lawful basis, notices and permissions required for your instructions and your subsequent use of information.
B. Your instructions
We process information only on your documented instructions, including instructions concerning international transfers, unless UK law requires otherwise.
These Terms, this schedule and your actions within the service provide the normal instructions. Additional instructions can be discussed through hello@brisksite.co.uk.
Where the law requires processing outside those instructions, we will inform you before processing unless the law prohibits that notification.
We will inform you immediately if, in our opinion, an instruction infringes applicable data protection law.
C. Confidentiality and security
We will ensure that people authorised to process the information are subject to appropriate confidentiality duties.
We will implement appropriate technical and organisational measures to protect information, taking account of the nature of the processing and the risks to individuals.
[Before publication: provide or link a verified security-measures description covering access controls, transmission, storage, operational safeguards and incident handling. Do not promise unverified controls.]
D. Service providers
You give general written authorisation for us to use the subprocessors identified in our separate subprocessor schedule.
We will impose data-protection obligations on them that provide the protection required by applicable law, and remain responsible to you for their performance of those obligations.
We will give at least 30 days’ notice by email before adding or replacing a subprocessor.
You may raise reasonable data-protection objections by emailing hello@brisksite.co.uk before the proposed change takes effect. We will work with you to try to resolve the concern.
If we cannot resolve a reasonable objection, you may end the affected service before the change takes effect and receive a refund of unused prepaid time.
We will make restricted international transfers only in accordance with your documented instructions and applicable UK data protection requirements.
[Before publication: complete and make available the named subprocessor schedule, processing locations and applicable international-transfer safeguards. Verify that the change-notice commitment can be supported.]
E. Assistance and incidents
Taking account of the nature of the processing, we will help you respond to requests from individuals exercising their data-protection rights.
Taking account of the information available to us, we will also assist with applicable security duties, breach notifications, data protection impact assessments and consultation with regulators.
We will notify you without undue delay after becoming aware of a personal-data breach affecting information we process on your behalf, and provide available information reasonably needed for your response.
F. Return and deletion
You can instruct us to delete information through the available controls or contact hello@brisksite.co.uk to request the return of personal information we process on your behalf.
We will verify your identity and authority, provide information still held on your behalf in a commonly readable format, and arrange secure delivery without disclosing other customers’ information.
Information already deleted cannot be recovered.
At the end of the relevant processing services, we will, at your choice, return or delete that personal information and delete existing copies unless UK law requires retention.
The agreed post-subscription storage period is a continuing, limited storage service under your instructions. You may instruct earlier deletion or request return of the personal information before scheduled cleanup.
This does not promise an export of Brisk’s software, templates, a deployable copy of your website or original photographs no longer held.
[Before publication: document the manual return process and verify backup-deletion arrangements. Ensure the process can fulfil the return and deletion commitments above.]
G. Demonstrating compliance
We will make available information necessary to demonstrate compliance with our processor obligations and allow and contribute to audits and inspections by you or an auditor you appoint.
Practical arrangements must protect other customers’ information and system security without preventing legally required oversight.
If this schedule conflicts with another part of the Terms about processing personal information on your behalf, this schedule takes precedence.
